Disclosure

Electronic Funds Agreement and Disclosure for First Source FCU One Card and Source 24 ATM Card.

This Statement contains important information about electronic funds transfer. In this Statement, the words “you”, “your” and “yours” means any holder or other authorized user of your First Source FCU One card or Source 24 ATM Card. The words “debit card” and “VISA® Check Card” also refer to your First Source FCU One card. The words “we” and “us” mean First Source Federal Credit Union. “PIN” means the personal identification number assigned to you for use with your debit or ATM Card. You may change your PIN number at any First Source location.

Agreement

By using or authorizing the use of the First Source FCU One Card and/or Source 24 ATM Card that the Credit Union sends you (or its account number) you agree to the terms of this agreement.

Types of transactions available

You may use your First Source FCU One or Source 24 ATM card to:

a) Withdraw cash from your designated checking or savings account.

b) Transfer funds between your savings and checking accounts

c) Obtain balance information about your designated checking and savings accounts.

d) Initiate point-of-sale transactions at certain POS terminals.

e) Initiate purchase transactions at all Merchant locations displaying the VISA® logo

(Your Source 24 ATM Card will allow you to transact the items listed above, except it will not allow you to initiate purchase transactions outlined in item e).

Some of these services may not be available at all terminals or to all members.

All withdrawals and transfers are subject to the customary rules and/or regulations which govern such transactions except where specifically modified in this agreement.

Limitations of Dollar Amounts of Transactions

You may withdraw up to $500 cash from an ATM and conduct up to $1000 in purchase or point-of-sale transactions per day with your First Source FCU One Card unless you have been told another limit is applicable to your account.

You may withdraw up to $500 cash from an ATM and conduct up to $500 in point-of-sale transactions per day with your Source 24 ATM Card unless you have been told another limit is applicable to your account.

Transaction Fee Schedule

There is not a charge for transactions done at an ATM owned by First Source FCU or a part of the Sharenet! Group. Contact First Source FCU for a current list of Sharenet! locations. Foreign Fees are “per transaction” and apply to ATM transactions at an ATM machine not owned by us or a part of the Sharenet! Group. See our Fee Schedule for a list of current fees.

There is not an initial fee or an annual fee for the First Source One Card or the Source 24 ATM Card. The Credit Union will furnish one card free on an individual account and two cards free on a joint account.

There is no charge for using your First Source FCU One card at a point-of-sale terminal or for purchase transactions at a Merchant displaying the VISA® logo. Note that for these transactions you should select the “credit” option when available.

Transactions

Your card or card number may not be used for any illegal transactions, such as unlawful gambling. The Credit Union may assume, without any further inquiry, that all transactions made by you or someone authorized by you using the card or card number are legal.

The Credit Union will decline all known online gambling transactions.

By using your First Source FCU One Card and/or Source 24 ATM Card you release the Credit Union from any and all liability, and you agree not to make a claim or bring any action against the Credit Union, for honoring or allowing any transactions by a person to whom you allowed account access, whether that person is a joint account holder or a person to whom you have given access to your card and/or PIN.

Foreign Transactions

Purchases and cash advances made in currencies other than U.S. dollars will be converted to and billed to you in U.S. dollars under the regulations established by VISA® International. We do not determine the currency conversion rate which is used, nor do we receive any portions of the currency conversion rate. The conversion rate to U.S. dollars will be (I) A rate selected by VISA® from the range of rates available in wholesale currency markets for the applicable central processing date, which rate may vary from the rate VISA® itself receives, or (II) the government –mandated rate in effect for the applicable central processing date, in each instance plus 1%. Conversion to U.S. dollars may occur on a date other than the transaction date: therefore, the currency conversion rate may be different than the rate in effect at the time of the transaction. You agree to pay both.

Business Days

Our normal business days are Monday through Friday. Holidays are not included.

Documentation of Transactions

You can get a receipt at the time you make any transaction at an ATM machine owned by us or point-of-sale terminal. You will receive a monthly account statement from us showing each transaction made with your First Source One card or Source 24 ATM Card. We recommend retaining your receipts until you have balanced your account to your statement.

Use of your First Source FCU One Card or Source 24 ATM Card

You may terminate this agreement with us by notifying us in writing or returning your card(s) to us. Notices by Internet e-mail to the Credit Union are not acceptable and will not be acted upon by the Credit Union. We may also terminate the use of your card(s) at any time and for any reasons. If we do, you must return your card(s) to us for cancellation and you must not permit the continued use of your card(s). We may terminate the use of your card(s) by telephone or in writing. If there is more than one cardholder, each is jointly and separately liable for all transactions initiated by the use if the card. By using the card you also agree that you will not make your card or PIN available to anyone else, and that you will not record the PIN on the card. The Credit Union is not responsible for establishing the identity of any person using your PIN. You also agree to use the card, PIN and any machine or terminal as instructed. If anyone uses your card(s) or you PIN or your account number with your permission, you will be responsible for any transactions performed by that person, even if that person exceeds the authority given.

Your Liability for Unauthorized Transactions

Tell us at once if you believe your card, PIN or other personal account information has been lost or stolen. Telephoning us is the best way of keeping your losses down. You could lose all the money in your account (plus your maximum overdraft line of credit). If a transaction is made with your card or card number without your permission, and is a VISA® transaction; you will have no liability for the transaction. Your liability for unauthorized use of your card or account will be determined under the following paragraphs for transactions that are not VISA® or for transactions at ATM’s.

If you believe your card, code or other personal account information has been lost or stolen and you notify us within 2 business days after you learn of the loss or theft you can lose no more than $50 if someone used your card or card number without your permission. If you do not tell us within 2 business days after you learn of the loss or theft of your card, code or personal information and we can prove we could have stopped someone from using your card without your permission if you had told us, you could lose as much as $500.

Also, if your statement shows transfers that you did not make, tell us at once. If you do not tell us within 60 days after the statement was mailed to you, you may not get back the money you lost after 60 days if we can prove that we could have stopped someone from taking the money if you had told us in time.

Our Liability for Failure to Make Transfers

If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we may be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance:

a) If, through no fault of ours, you do not have enough money in your account to make the transfer,

b) If the automatic teller machine where you are making a withdrawal does not have enough cash,

c) If the terminal or system was not working properly and you knew about the breakdown when you started the transfer,

d) If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we may have taken,

e) If your account has been tied up by legal proceedings or other action,

f) There may be other exceptions stated in our agreements with you.

Disclosure of Account Information to Third Parties

We will not disclose information to third parties about your account or the transfer you make except:

a) Where it is necessary for completing transfers, or

b) In order to verify the existence and condition of your account for a third party, such as a credit bureau or merchant, or

c) In order to comply with a government agency or court order, or

d) If you give us written permission, or

e) In order to advise third parties that your account was closed for misuse.

Governing Law

The laws of the United States and the State of New York shall govern this agreement.

Amendment

We may amend this agreement at any time. However, we will give you at least 30 days notice if any amendment results in greater cost or liability to you or otherwise reduces access to your account, unless an immediate change in terms or conditions is necessary to maintain or restore the security of the system or your accounts. The notice will be sent to you at your address shown on our records, unless you have notified us, in writing, of another address.

Any use of the First Source FCU One Card and/or Source 24 ATM Card after we send you notice of the change or amendment will constitute your agreement to such change(s) or amendment(s). If you do not agree to the change or amendment, you must notify us in writing prior to the effective date of the change or amendment and terminate this agreement.

Notify us as soon as you can, if you think your statement or receipt is wrong or if you need more information about a transfer listed in the statement or receipt. We must hear from you no later than 60 days after we sent the statement on which the problem or error appeared.

a) Tell us your name, account number and card number.

b) Describe the error or the transfer you are unsure about and explain as clearly as you can why you believe it is an error or why you need more information.

c) Tell us the dollar amount of the suspected error.

d) Tell us a telephone number at which you can be reached in the event we need any additional information.


If you tell us orally, we retain the right to require that you also send us your complaint or questions in writing within 10 business days. Notices by Internet e-mail to the Credit Union are not acceptable and will not be acted upon by the Credit Union.

We will determine whether an error occurred within 10 business days (20 business days if the transfer involved a new account) after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days (90 days if the transfer involved a new account, a point-of-sale transaction, or a foreign-initiated transfer) to investigate your complaint or question. If we decide to do this, we will credit your account with provisional credit, within 10 business days (20 business days if the transfer involved a new account) for the amount that you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within 10 business days, we may not credit your account.

Your account is considered a new account for the first 30 days after the initial deposit is made, unless you already have an established account with us before this account is opened.

We will tell you the results within three business days after completing our investigation. If we decide that there was no error, we will send you a written explanation. You may ask for copies of the documents that we used in our investigation.


IMPORTANT INFORMATION ABOUT ATM SAFETY

ATMs provide the convenience of having access to your account at any time, from any location. You should be aware of the following safety tips for your personal protection:

Activity at most ATMs is recorded by surveillance cameras. All ATMs owned by First Source Federal Credit Union are equipped with cameras.
If the ATM is in an enclosed area, close the entry door completely upon entering and exiting.
Don’t permit anyone you don't know to enter with you after regular banking hours.
Put withdrawn cash away before exiting the ATM facility.
Be sure to use only well-lit ATMs during evening hours.
When you make an ATM transaction, be mindful of your surroundings. Look out for suspicious activity near the ATM facility. If you observe any problem, go to another ATM facility.
If someone approaches you and demands your money, don't resist. Try to remember everything you can about the incident. The nearest public telephone should be used to call police if emergency assistance is needed.
At a drive-up ATM, make sure all the car doors are locked and all the windows are rolled up except the driver's window. Keep the engine running and remain alert to your surroundings.
Protect the secrecy of your PIN (Personal Identification Number). Don't tell anyone your PIN and do not write your PIN down where it might be discovered.
If your ATM card is lost or stolen, notify us immediately.
